Agreement to Terms Services Payment for Services Shipment Weight and Inspection Shipper’s Responsibilities RaceExpress will hold undeliverable packages and will contact shipper. If the sender does not respond on first attempt, the package will beheld for 5 days after delivery date. The shipper will be notified by mail (letter and certified). Following this notification, if shipper does not respond the other steps will be taken. The shipper will be responsible for any charges that were incurred for notification Right of Refusal RaceExpress reserves the right to refuse or reject any shipment and may do so at their sole discretion and without liability. RaceExpress may exercise this right at any time and includes situations (as well as others), when a shipment may cause other shipments to be delayed. A shipment that may cause harm to our employees, property damage due to leakage of an item, and error in transit due to improper packaging. Refusal of service also can be exercised because package contains prohibited items, when the account of the shipper is not in good standing or when acceptance of a shipment may jeopardize RaceExpress ability to provide services to other customers. Hazardous Material/Dangerous Goods RaceExpress will not delivery dangerous good or hazardous material under this shipment agreement. RaceExpress will not deliver any flammable goods as well. Limitation on Liability and Liabilities Not Assumed RaceExpress declares a limited value limited to the lesser of $100.00(U.S.) or the actual cash value of a shipment (which includes all documents and packages on consignment to RaceExpress in a single order) that is lost or damaged while in the delivery status by RaceExpress. The shipper can request a higher value of the package if it exceeds the amount allowed by RaceExpress. Additional fees will be incurred and will vary depending on the value declared by shipper. RaceExpress will not be held liable for loss, damage or delay for any unforeseen act of God, not limited to the weather, floods, war, terrorism, strikes, labor problem, gas shortages, any act of default of shipper or consignee and any violation of Terms and Conditions. Declared Value Limits The shipper can select a higher value for a damages or loss purposes (not caused by delay) which can relay at time of scheduling or on online order form. The additional fee is .65 cents per $100.00 (U.S.) Values of special items can not exceed $500.00. Shipping items that fall under this category are listed as jewelry, paintings, furs, motorized vehicles, electronics, clothing, wine and liquor, antiques and other exclusive items. Any other items for shipment can not exceed the declared value of $5000.00. Any item with this declared value must be first approved by RaceExpress with an approval number for pickup. Once shipper receives authorization for the higher declared value RaceExpress maximum liability shall be the value so declared or the actual cash value of the shipment, whichever is less. Claims The shipper is responsible of proving value of shipped item. All claims of damaged or lost shipments must be received in our office before the sixth day after delivery of said item. This claim must be in the form of a letter stating time and date of delivery, senders name and description of problem with item. The original packaging must be available for RaceExpress for preliminary inspection of it. |
